Terms Of Service

1. Acceptance of Terms

A. By using and/or visiting this site (collectively, including all content available through the FictionWritersBlog.com domain name and any country-specific domains or subdomains thereof, "FictionWritersBlog", or "FWB", or “our”, or “we”, or “us”, or “site”), you signify your agreement to (1) these terms and conditions (the "Terms of Service"), (2) FWB's privacy notice and incorporated here by reference, and (3) FWB's rules and also incorporated here by reference ("Agreement"). If you do not agree to any of these terms, the privacy notice, or the rules, please do not use our site.

B. Although we may attempt to notify you when major changes are made to these Terms of Service, you should periodically review the most up-to-date version. We may, at our sole discretion, modify or revise these Terms of Service and policies at any time, and you agree to be bound by such modifications or revisions. Nothing in this Agreement shall be deemed to confer any third-party rights or benefits.

 

2. Site

A. These Terms of Service apply to all users of FictionWritersBlog, including users who are also contributors of text content, information, and other materials or services on the site.

B. Our site may contain links to third party sites that are not owned or controlled by us. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third party sites. In addition, we will not and cannot censor or edit the content of any third-party site. By using the site, you expressly relieve us from any and all liability arising from your use of any third-party site.

 

3. Accounts

A. In order to access some features of the site, you will have to create an account. You may never use another's account without permission. When creating your account, you must provide accurate and complete information. You are solely responsible for the activity that occurs on your account, and you must keep your account password secure. You must notify us immediately of any breach of security or unauthorized use of your account.

B. Although we will not be liable for your losses caused by any unauthorized use of your account, you may be liable for any losses to us or others due to such unauthorized use.

 

4. General Use of the Site

FWB hereby grants you permission to access and use the site as set forth in these Terms of Service, provided that:

A. You agree not to distribute in any medium any part of the site, including but not limited to User Submissions (defined below), without FWB’s prior written authorization.

B. You agree not to alter or modify any part of the site.

C. You agree not to access User Submissions (defined below) or the site’s content through any technology or means other than the site itself.

D. You agree not to use the site for any commercial use, without the prior written authorization of FWB. Prohibited commercial uses include any of the following actions taken without our express approval:

  • sale of access to the site or its related services on another site;
  • use of the site or its related services for the primary purpose of gaining advertising or subscription revenue;
  • the sale of advertising, on the site or any third-party site, targeted to the content of specific User Submissions or FictionWritersBlog content;
  • and any use of the site or its related services that FictionWritersBlo finds, in its sole discretion, to use FictionWritersBlog's resources or User Submissions with the effect of competing with or displacing the market for FictionWritersBlog, its content, or its User Submissions.

E. You agree not to use or launch any automated system, including without limitation, "robots," "spiders," or "offline readers," that accesses the site in a manner that sends more request messages to the FictionWritersBlog’s servers in a given period of time than a human can reasonably produce in the same period by using a conventional on-line web browser. Notwithstanding the foregoing, we grant the operators of public search engines permission to use spiders to copy materials from the site for the sole purpose of and solely to the extent necessary for creating publicly available searchable indices of the materials, but not caches or archives of such materials. FWB reserves the right to revoke these exceptions either generally or in specific cases. You agree not to collect or harvest any personally identifiable information, including account names, from the site, nor to use the communication systems provided by the site (e.g. comments, email) for any commercial solicitation purposes. You agree not to solicit, for commercial purposes, any users of the site with respect to their User Submissions.

F. In your use of the site, you will otherwise comply with the terms and conditions of these Terms of Service, guidelines, and all applicable local, national, and international laws and regulations.

G. FWB reserves the right to discontinue any aspect of the site at any time.

 

5. Use of Content on the Site

In addition to the general restrictions above, the following restrictions and conditions apply specifically to your use of content on the site.

A. The content on the FWB site, except all User Submissions (as defined below), including without limitation, the text, software, scripts, graphics, codes, photos, sounds, music, videos, interactive features and the like ("Content") and the trademarks, service marks and logos contained therein ("Marks"), are owned by or licensed to FWB, subject to copyright and other intellectual property rights under the law. Content on the site is provided to you AS IS for your information and personal use only and may not be downloaded, copied, modified, produced, reproduced, distributed, transmitted, broadcast, displayed, sold, licensed, translated, published, performed or otherwise exploited for any other purposes whatsoever without the prior written consent of the respective owners. FWB reserves all rights not expressly granted in and to the site and the Content. B. You may access User Submissions solely:

  • for your information and personal use;
  • as intended through the normal functionality of the FWB Service;

C. You may access FWB’s Content, User Submissions and other content only as permitted under this Agreement. FWB reserves all rights not expressly granted in and to the FWB Content and Service.

D. You agree to not engage in the use, copying, or distribution of any of the Content other than expressly permitted herein, including any use, copying, or distribution of User Submissions of third parties obtained through the site for any commercial purposes.

E. You agree not to circumvent, disable or otherwise interfere with security-related features of the site or features that prevent or restrict use or copying of any Content or enforce limitations on use of the site or the content therein.

F. You understand that when using the site, you will be exposed to User Submissions from a variety of sources, and that we are not responsible for the accuracy, usefulness, safety, or intellectual property rights of or relating to such User Submissions. You further understand and acknowledge that you may be exposed to User Submissions that are inaccurate, offensive, indecent, lewd, vulgar, obscene, or objectionable, and you agree to waive, and hereby do waive, any legal or equitable rights or remedies you have or may have against FWB with respect thereto, and agree to indemnify and hold FWB, its Owners/Operators, affiliates, and/or licensors, harmless to the fullest extent allowed by law regarding all matters related to your use of the site.

 

6. User Submissions and Conduct

A. As an account holder on the site, you may submit textual, visual, or audiovisual content. User submitted content is collectively referred to as "User Submissions." You understand that whether or not such User Submissions are published, we do not guarantee any confidentiality with respect to any User Submissions.

B. You shall be solely responsible for your own User Submissions and the consequences of posting or publishing them. In connection with User Submissions, you affirm, represent, and/or warrant that: you own or have the necessary licenses, rights, consents, and permissions to use and authorize us to use all patent, trademark, trade secret, copyright or other proprietary rights in and to any and all User Submissions and have all necessary consents to collect, use and disclose any personally identifiable information contained or displayed in any and all User Submissions to enable inclusion and use of the User Submissions in the manner contemplated by the site and these Terms of Service.

C. For clarity, you retain all of your ownership rights in your User Submissions. However, by submitting User Submissions to FWB, you hereby grant us a worldwide, non-exclusive, royalty-free, transferable license to use, reproduce, distribute, display, and perform the User Submissions in connection with the site. You also hereby waive any moral rights you may have in your User Submissions and grant each user of the site a non-exclusive license to access your Submissions. You understand and agree, however, that FWB may retain, but not display, distribute, or perform, server copies of User Submissions that have been removed or deleted.

D. In connection with User Submissions, you further agree that you will not submit material that is copyrighted, protected by trade secret or otherwise subject to third party proprietary rights, including privacy and publicity rights, unless you are the owner of such rights or have permission from their rightful owner and the necessary consents from any individuals whose personally identifiable information is contained in such material to post the material and to grant us all of the license rights granted herein.

E. You further agree that you will not, in connection with User Submissions, submit material that is contrary to the site’s guidelines, which may be updated from time to time, or contrary to applicable local, national, and international laws and regulations.

F. We not endorse any User Submission or any opinion, recommendation, or advice expressed therein, and we expressly disclaim any and all liability in connection with User Submissions. We do not permit copyright infringing activities and infringement of intellectual property rights on our site, and will remove all Content and User Submissions if properly notified that such Content or User Submission infringes on another's intellectual property rights or contravenes any applicable privacy legislation. We reserve the right to remove Content and User Submissions without prior notice.

 

7. Account Termination Policy

A. We will terminate a User's access to the site if, under appropriate circumstances, the User is determined to be an infringer.

B. We reserve the right to decide whether Content or a User Submission is appropriate and complies with these Terms of Service for violations other than copyright infringement or privacy law, such as, but not limited to, hate crimes, overt violence, defamatory material, or excessive length. We may remove such User Submissions and/or terminate a User's access for uploading such material in violation of these Terms of Service at any time, without prior notice and at our sole discretion.

 

8. Copyright Policy

As part of FWB’s copyright policy, we may terminate user access to the site if a user has been determined to be an infringer. To file a copyright infringement notification, you will need to send a communication to us with all of the following information in it, using this format:

  1. Include a statement telling us that you have found content on FWB which you believe infringes your copyright (for example, "I hereby confirm that I believe the story identified below infringes my copyright").
  2. Tell us which country your copyright applies to.
  3. Tell us the title of the content concerned and the full URL for the page.
  4. Explain to us in what way the content infringes your copyright (e.g. the text is copied, the entire story is a copy of an original work made by you, etc.)
  5. Identify the type (e.g. a book, a short story, a poem, etc.). and details of (e.g. title, publisher, dates, etc.) the copyright work which you own the rights in, and which you believe has been infringed. If this information is available on the internet, it is helpful to send us a link.
  6. Let us have contact information so that we can get in touch with you (email address is preferred).
  7. Let us have the contact information which we can pass on to the alleged infringer, so that they can get in touch with you to resolve your complaint directly (email address is preferred).
  8. Include the following statement: "I have a good faith belief that use of the copyrighted work described above is not authorized by the copyright owner (or by a third party who is legally entitled to do so on behalf of the copyright owner) and is not otherwise permitted by law."
  9. Add also, “I swear that the information contained in this notification is accurate and that I am the copyright owner or have an exclusive right in law to bring infringement proceedings with respect to its use.”
  10. Sign the notice. If you are providing notice by e-mail, a scanned physical signature or a valid electronic signature will be accepted.

Please also note that the information provided in this legal notice may be forwarded to the person who provided the allegedly infringing content. Make sure you know whether the content that you have seen on our site infringes your copyright. Be aware that there may be adverse legal consequences in your country if you make a false or bad faith allegation of copyright infringement by using this process.

 

9. Warranty and Condition Disclaimer

10. Limitation of Liability

IN NO EVENT SHALL FICTIONWRITERSBLOG, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS, BE LIABLE TO YOU FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES WHATSOEVER RESULTING FROM ANY

(I) ERRORS, MISTAKES, OR INACCURACIES OF CONTENT,

11. Indemnity

You agree to defend, indemnify and hold harmless FictionWritersBlog, its parent corporation, officers, directors, employees and agents, from and against any and all claims, demands, causes of action, damages, obligations, losses, liabilities, costs or debt, and expenses, (including but not limited to reasonable legal fees) arising from:

12. Ability to Accept Terms of Service

You affirm that you are either more than the age of majority in your jurisdiction of residence, or an emancipated minor, or possess legal parental or guardian consent, and are fully able and competent to enter into the terms, conditions, obligations, affirmations, representations, and warranties set forth in these Terms of Service, and to abide by and comply with these Terms of Service. You affirm that you are over the age of 18, as the site is not intended for those under 18.

 

13. Assignment

These Terms of Service, and any rights and licenses granted hereunder, may not be transferred or assigned by you, but may be assigned by FWB without restriction.

Unless prohibited by local law, any claim or dispute between you and FictionWritersBlog that arises in whole or in part from the site shall be decided exclusively by a court of competent jurisdiction located in Clarke County, Alabama. If any provision of these Terms of Service is deemed invalid by a court of competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of these Terms of Service, which shall remain in full force and effect. TO THE MAXIMUM EXTENT PERMITTED BY LOCAL LAW, YOU AND FWB AGREE THAT ANY CAUSE OF ACTION ARISING OUT OF OR RELATED TO THE SITE MUST COMMENCE WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES. OTHERWISE, SUCH CAUSE OF ACTION IS PERMANENTLY BARRED.

Fiction Rated: G

A G-rated motion picture contains nothing in theme, language, nudity, sex, violence or other matters that, in the view of the Rating Board, would offend parents whose younger children view the motion picture. The G rating is not a “certificate of approval,” nor does it signify a “children’s” motion picture. Some snippets of language may go beyond polite conversation but they are common everyday expressions. No stronger words are present in G-rated motion pictures. Depictions of violence are minimal. No nudity, sex scenes or drug use are present in the motion picture.

Fiction Rated: PG

A PG-rated motion picture should be investigated by parents before they let their younger children attend. The PG rating indicates, in the view of the Rating Board, that parents may consider some material unsuitable for their children, and parents should make that decision.

The more mature themes in some PG-rated motion pictures may call for parental guidance. There may be some profanity and some depictions of violence or brief nudity. But these elements are not deemed so intense as to require that parents be strongly cautioned beyond the suggestion of parental guidance. There is no drug use content in a PG-rated motion picture.

Fiction Rated: PG13

A PG-13 rating is a sterner warning by the Rating Board to parents to determine whether their children under age 13 should view the motion picture, as some material might not be suited for them. A PG-13 motion picture may go beyond the PG rating in theme, violence, nudity, sensuality, language, adult activities or other elements, but does not reach the restricted R category. The theme of the motion picture by itself will not result in a rating greater than PG-13, although depictions of activities related to a mature theme may result in a restricted rating for the motion picture. Any drug use will initially require at least a PG-13 rating. More than brief nudity will require at least a PG-13 rating, but such nudity in a PG-13 rated motion picture generally will not be sexually oriented. There may be depictions of violence in a PG-13 movie, but generally not both realistic and extreme or persistent violence. A motion picture’s single use of one of the harsher sexually-derived words, though only as an expletive, initially requires at least a PG-13 rating. More than one such expletive requires an R rating, as must even one of those words used in a sexual context. The Rating Board nevertheless may rate such a motion picture PG-13 if, based on a special vote by a two-thirds majority, the Raters feel that most American parents would believe that a PG-13 rating is appropriate because of the context or manner in which the words are used or because the use of those words in the motion picture is inconspicuous.

Fiction Rated: R

An R-rated motion picture, in the view of the Rating Board, contains some adult material. An R-rated motion picture may include adult themes, adult activity, hard language, intense or persistent violence, sexually-oriented nudity, drug abuse or other elements, so that parents are counseled to take this rating very seriously. Children under 17 are not allowed to attend R-rated motion pictures unaccompanied by a parent or adult guardian. Parents are strongly urged to find out more about R-rated motion pictures in determining their suitability for their children. Generally, it is not appropriate for parents to bring their young children with them to R-rated motion

Fiction Rated: NC-17

An NC-17 rated motion picture is one that, in the view of the Rating Board, most parents would consider patently too adult for their children 17 and under. No children will be admitted. NC-17 does not mean “obscene” or “pornographic” in the common or legal meaning of those words, and should not be construed as a negative judgment in any sense. The rating simply signals that the content is appropriate only for an adult audience. An NC-17 rating can be based on violence, sex, aberrational behavior, drug abuse or any other element that most parents would consider too strong and therefore off-limits for viewing by their children.
